Terms of Service
Welcome. These terms govern your use of vocapi, a language-learning service operated by Johnathan Jay Oneal ("we", "our"). By creating an account or using the app, you agree to these terms.
The short version
- You can use vocapi to learn languages. We will do our best to keep it working.
- Don't try to break it, abuse other users, or use it for things that are illegal.
- If you pay for a subscription, you pay through the App Store or Google Play. They handle the money.
- Mission-supported language courses are free. We may change pricing for paid languages with notice.
- You can delete your account at any time. We can terminate accounts that violate these terms.
- The service is provided "as is" — we make no guarantees beyond what consumer protection law requires.
Your account
You sign in using a Google or Apple account. You are responsible for keeping that underlying account secure. You may have one vocapi account per person.
You must be at least 13 years old (16 in the EU) to use vocapi. If you are under the age of majority in your country, you confirm a parent or guardian has consented to your use.
Subscriptions and payments
Free tier
Courses designated by vocapi as mission-supported are available at no cost, indefinitely. This is part of vocapi's stewardship commitment and is not a trial.
Paid tier
Other languages may require a paid subscription. Pricing, billing cycles, and any free trials are shown to you at the point of purchase inside the app, before you confirm.
How billing works
Subscriptions are billed by the App Store (iOS) or Google Play (Android). We do not handle your payment information. Renewals, refunds, and cancellations follow the rules of the store you purchased through. To cancel a subscription, use the App Store or Google Play subscription settings — uninstalling the app does not cancel.
Refunds
Refund requests are handled by Apple or Google. We do not have the ability to issue refunds directly. If a payment was clearly in error, contact us atour support page and we will do our best to help.
Price changes
We may change prices for paid languages. We will give you at least 30 days' notice in the app or by email before any change takes effect. If you do not agree, you can cancel before the new price applies.
What you can and cannot do
You may:
- Use vocapi to learn and study, including for personal, educational, or professional purposes.
- Take notes, screenshots, or excerpts for your own learning.
- Share your reasonable impressions of the app (reviews, blog posts, etc.).
You may not:
- Reverse-engineer, decompile, or attempt to extract our source code or proprietary algorithms (except where law permits this notwithstanding the terms).
- Scrape, bulk-download, or systematically copy content from the app or our backend.
- Use vocapi to send spam, harass other users, attempt to gain unauthorized access, or interfere with the service's operation.
- Resell, sublicense, or commercially redistribute vocapi content.
- Misrepresent your identity or impersonate someone else.
Content ownership and licensing
Our content. vocapi's lessons, exercises, audio, and software are owned by us or our licensors and are protected by copyright. We grant you a personal, non-exclusive, non-transferable, revocable license to access and use them through the app.
Stewardship content. When source material is contributed under an agreement with a language community, teacher, institution, or other rights holder, that agreement defines ownership, permitted use, attribution, review, and withdrawal. Vocapi does not claim ownership merely because material appears in the app.
Your contributions. If you submit feedback, suggestions, or corrections, you grant us a worldwide, non-exclusive, royalty-free license to use them to improve the product. We will not publish anything that personally identifies you without your consent.
Termination
You can terminate this agreement at any time by deleting your account in Settings. We may suspend or terminate your account if you materially violate these terms, if continued service exposes us to legal risk, or if you have not used the account for an extended period and we are retiring inactive accounts.
On termination, your account and learning data are deleted. Subscription cancellation is handled by the store you paid through.
Service availability and changes
We may add, remove, or change features. We may take the service down for maintenance, updates, or unforeseen issues. For material reductions in functionality, we will give reasonable notice.
We do not guarantee uninterrupted service or that the app will be free of bugs. We will work in good faith to fix issues promptly.
Disclaimers
Except to the extent required by consumer protection law in your country, the service is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not warrant that the service will meet your specific learning goals or that using it will result in fluency.
Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising out of your use of vocapi is limited to the amount you paid us in the 12 months preceding the claim, or US $50, whichever is greater. We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages. Nothing in these terms limits liability that cannot be limited under applicable law.
Disputes
If you have a concern, please contact us first — we genuinely prefer to resolve issues directly. You always retain whatever rights you have under the consumer protection laws of your country.
Changes to these terms
We may update these terms occasionally. If a change is material, we will notify you in the app or by email at least 30 days before it takes effect. Continued use after the change means you accept the new terms. If you do not agree, you can stop using the service and delete your account.
